Form40. Motion for Substitution of Transferee.

    __________, a corporation incorporated under the laws of the State of __________ and with its principal place of business in that state, shows to the court that this is an action [state briefly the material facts indicating that the claim is assignable]; that __________, plaintiff herein, by written assignment dated ______, 19___, a copy of which is attached hereto and marked Exhibit A, assigned to the said __________ all of his right, title and interest in the claim herein; and that the said __________ has been and is now the lawful owner of the claim asserted herein.

    Wherefore, the said __________, moves this court for an order substituting it as party plaintiff herein in place of __________, or in the alternative for an order joining it as a party plaintiff herein.
