Art. 4553. Post-judgment proceedings

    A. Except for good cause shown, the court and division or section rendering an interdiction judgment shall conduct all post-judgment proceedings related to the interdiction.

    B. Except for good cause shown, all proceedings for injunction pursuant to Article 3601 et seq., including ancillary proceedings, involving an interdicted person as applicant or as an adverse party, shall be conducted by the court and division or section rendering the interdiction judgment.

    C. Any proceeding under this Article pending in any court or division, or section, other than the court and division or section rendering the interdiction judgment, shall be transferred immediately to the court and division or section rendering the interdiction judgment upon motion of any party or upon motion of the court.

    LEGISLATIVE INTENT; APPLICATION--ACTS 2008, NO. 806

    Sections 2 and 3 of Acts 2008, No. 806 (§ 1 of which amended this article) provide:

    “Section 2. The provisions of Code of Civil Procedure Article 4553(B) as enacted by this Act are intended to clarify the law by stating that ‘post-judgment proceedings related to the interdiction’ includes proceedings for temporary restraining orders, preliminary injunctions, and permanent injunctions.

    “Section 3. The provisions of this Act are interpretative of Code of Civil Procedure Article 4553 and are intended to
explain and clarify its original intent. Therefore, the provisions of this Act shall be applicable to all claims existing or
actions pending on its effective date [July 7, 2008] and to all claims arising or actions filed on and after its effective date; provided however, that all orders and judgments previously issued in any proceeding transferred in accordance with the provisions of this Act shall remain in full force and effect, except as provided by other provisions of the Code of Civil Procedure.”
