§ 1208.67. Proceeds of sale

    The proceeds of the sale must be applied to the discharge of the lien and the cost of keeping and selling the property. The remainder, if any, shall be paid to the legal owner.

    VALIDITY

    This section was held unconstitutional as a violation of procedural due process in the decision of Martin v. Heady (Cal.App., 1980), 163 Cal.Rptr. 117, 103 Cal.App.3d 580.
