§ 1298.7. Actions for bodily injury, wrongful death, or actions under §§ 337.1, 337.15

    In the event an arbitration provision is included in a contract or agreement covered by this title, it shall not preclude or limit any right of action for bodily injury or wrongful death, or any right of action to which Section 337.1 or 337.15 is applicable.

    VALIDITY

    This section was held to be preempted by the Federal Arbitration Act in the decision of Shepard v. Edward Mackay Enterprises, Inc. (App. 3 Dist. 2007) 56 Cal.Rptr.3d 326, 148 Cal.App.4th 1092.
