§ STANDARD III SERVICES TO BE PROVIDED AND GENERAL REQUIREMENTS FOR PARTICIPATION BY LAWYERS
STANDARD III. SERVICES TO BE PROVIDED AND GENERAL REQUIREMENTS FOR PARTICIPATION BY LAWYERS
(a) Each Service shall provide a panel or panels of lawyers to whom referrals of persons requesting the same can be made through the Service, in rotation, when practicable.
(b) The referral panel or panels or other services offered by the Lawyer Referral Service may be separate operations supervised by the Referral Service for which separate rules, regulations and fees may be established, depending upon the nature of the panel and other appropriate considerations.
(c) Lawyers may not be required to participate in all of such services in order to participate in any one of them; provided, however, that with respect to referral panels, lawyers may be required to participate on reduced fee or pro bono panels in order to participate in full fee generating panels.
(d) The Lawyer Referral Service shall encourage lawyers to participate in the Service. Only lawyers who are members of the Bar in good standing and licensed to practice in Florida may participate.
(e) Each participating lawyer shall agree that:
1. The information contained in the application or records of the Referral Service may be furnished to the Lawyer Referral Service Committee or its governing body as the need arises;
2. The member's name may be removed from any or all of the referral panels upon a vote of the majority of all of the members of the Lawyer Referral Service Committee; provided that the attorney has been accorded a reasonable opportunity to appear before such committee and defend against such action and the right to appeal such action to the governing body of such Lawyer Referral Service committee (during which period further referrals may be suspended). In the event there is no Lawyer Referral Service committee, the governing body of the Lawyer Referral Service will resolve all disputes;
3. A panel member will pay to the Service all applicable fees and charges prescribed by the Service, if any;
4. The member will abide by all rules of the Service;
5. In the event of a dispute over attorney fees with a client referred by the Service the member agrees to submit the dispute to a local or state fee arbitration committee for resolution, if available.
